According to investigations by law enforcement agencies and information circulated in the media, there have recently been cases of citizens of the Republic of Azerbaijan taking part in the ongoing military operations between Russia and Ukraine, as well as in other armed conflicts, the Prosecutor General’s Office of Azerbaijan reports.
“It is with regret that we note that among those killed, seriously wounded, or taken captive as a result of these combat operations are also our citizens.
We hereby inform that the Republic of Azerbaijan, considering the protection of the life, security, rights, and freedoms of its citizens as the highest goal and duty of the state, and guided by the principle of the inevitability of legal responsibility, demonstrates a firm and uncompromising position toward any person engaged in unlawful activities.
Thus, participation in armed conflicts on the territory of foreign states is not merely a personal choice, but, in accordance with national criminal legislation and the requirements of international conventions, constitutes a grave crime, and in some cases an especially grave crime.
Under the Criminal Code of the Republic of Azerbaijan, mercenarism — that is, participation in activities for the purpose of obtaining material reward by a citizen of a state not party to a military conflict or military operations, who does not permanently reside in the territory concerned and is not sent to perform official duties — as well as participation in the activities of armed formations or groups not предусмотренные by the legislation of the Republic of Azerbaijan, is considered a criminal offense punishable by imprisonment for a specified term (from 8 to 20 years) or life imprisonment.
We bring to the attention of our citizens that, regardless of any ideological, material, personal, or other interests, participation in armed formations not provided for by the legislation of the Republic of Azerbaijan is considered a criminal offense.
Law enforcement agencies have initiated criminal cases against a number of our citizens engaged in such activities. In some cases, the preliminary investigation has been completed, the cases have been referred to the relevant courts for consideration, and sentences providing for long terms of imprisonment have been handed down against those found guilty. Preliminary investigations into other criminal cases of this category are currently ongoing.
The law enforcement agencies of our country are taking all necessary measures to prevent the above-mentioned offenses, as well as to identify and bring to justice those who have committed unlawful acts.
We remind that, under the Constitution, a citizen of Azerbaijan is obliged to comply with the laws of their state and to defend their homeland. No material interest can be more important than your life, your freedom, and your future. Avoiding unlawful actions and protecting national interests are the moral and legal responsibility of each of us.
We call on our citizens to remain vigilant, not to succumb to illegal calls, and to respect the laws of our state,” the statement says.
It should be noted that recently, reports have been circulating on social media about the participation of Azerbaijani citizens in the war on the territory of Ukraine. These publications also claim cases of Azerbaijani citizens being killed in the combat zone.
